1. Who we are

One Night Haunt (onenighthaunt.com) is run by Gerard Delgado Casanovas, a sole proprietor, at Rue de Morat 37, 1700 Fribourg, Switzerland (“we”, “us”). You can reach us at [email protected]. By using the site or buying a ghost, you agree to these terms. If you are under 18, you need a parent’s or guardian’s permission to buy.

2. What you buy

A ghost is a small drawing in the One Night Haunt house. It shows the name, message, colour, pattern, face and accessory you choose, at the spot you pick. Human-sized ghosts can also show a link, a logo and an image printed on the whole sheet. We check every human-sized ghost by hand before it appears.

The house opens in four parts (the house, the attic, the garden and the cemetery). Each part opens when the one before it is 80% full. Your ghost goes in a part that is open.

If someone takes your spot while you pay, a cat-sized or kid-sized ghost goes to the nearest free spot. A human-sized ghost goes to another free human-sized spot in the same part of the house. If there is no free spot, you get your money back.

Your ghost is a fully automated digital item. It does not give you ownership of any part of the site, it has no money value, and it cannot be transferred, resold or exchanged for money.

3. Sizes and prices

The base price starts at €2.00 and goes up by €0.01 with every ghost sold. We charge in euros (EUR). Prices include VAT or sales tax where they apply. If your card uses another currency, your bank may convert the amount and charge its own fee.

The price can go up while you choose your spot. If it does, the page shows you the new price before you pay. You are never charged more than the price shown to you.

When you start paying, we hold your spot for 15 minutes. For an exorcism, we hold the ghost you want to replace. If you don’t finish paying in that time, the spot is free again for everyone.

4. Human-sized spots and exorcisms

The 31 human-sized spots are spread over the four parts of the house and become available as each part opens. Once every human-sized spot in the open parts is taken, anyone can take one by paying at least 10% more than its current holder paid. This is called an exorcism. The previous ghost stays in the house at kid size, close to where it was, without its logo, image and link. Buying a human-sized spot does not guarantee you keep it until the house closes. An exorcism is a fixed-price purchase, not a bet or a lottery, and there are no prizes.

5. Closing

The house closes on 31 October 2026 at midnight New York time (05:00 on 1 November in Switzerland). After that, nobody can add ghosts or exorcise them. We will keep the house online as it was at closing until at least 31 October 2031.

6. Your content

You confirm that you have the right to use the name, message, logo, image and link you submit. You must not submit:

You give us a free, worldwide, non-exclusive licence to show your ghost and its content on the site, on share images, and in posts and press about One Night Haunt, for as long as the site is online. Your own name and logo stay yours.

7. Moderation

Names and messages pass an automatic filter before you pay. If the filter blocks a text, you can’t buy a ghost with it. Human-sized ghosts are checked by hand. Until we approve them, they show in the house as “Reserved”.

We may reject or remove any ghost that breaks section 6. If we reject a ghost before it appears, you get a full refund. If only the logo or the image breaks section 6, we may approve your ghost without it instead; it then shows your initials. If we remove a ghost later because it breaks section 6, we don’t refund it, unless the law says otherwise. We may also move a ghost slightly to keep the house readable.

8. Payments

Our order process is conducted by our online reseller Dodo Payments. Dodo Payments is the merchant of record for all our orders: it charges you, collects any VAT or sales tax, sends your receipt and handles payment support. We provide the ghost and the site.

9. Purchases are final once your ghost is placed

Your ghost goes into the house as soon as your payment is confirmed. Before you pay, you tick a box that says:

We store the version of the text you ticked, and the time you started the payment, with your order.

If you live in the EU, you normally have 14 days to withdraw from an online purchase. That right does not apply to digital content that is supplied straight away, after you have expressly agreed to this and confirmed that you lose the right. That is what the box does. Swiss law has no general right of withdrawal for online purchases.

So once your ghost is placed, your purchase is final. Exorcisms are final too. You still get your money back automatically if we can’t place your ghost, if we reject it in moderation, and in the other cases listed in our Refund Policy. None of this limits the rights you have under mandatory consumer law.

If you dispute your payment with your bank or card issuer (a chargeback), your ghost is hidden while the dispute is open. If the payment is reversed, your ghost leaves the house. Otherwise, it comes back.

10. Using the site fairly

Don’t attack, overload, scrape or probe the site, don’t use bots to buy ghosts, and don’t use it for fraud. We may block purchases or remove ghosts linked to fraud, payment disputes or abuse.

11. Our rights

The site, the house illustration and the ghost designs belong to us.

12. No guarantees

We provide the site as it is. It may sometimes be slow or unavailable, and we can’t promise it will be free of errors.

13. Liability

As far as the law allows, our total liability to you is limited to the amount you paid us. This does not limit liability for intent or gross negligence, or any rights you have under mandatory consumer law.

14. Changes

We may update these terms. The version in force when you bought a ghost applies to that purchase.

15. Law and courts

Swiss law applies. Courts at our place of residence have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws and courts of the country where you live.
